How to find reduced working hours
In order to correctly find the standard of working time for an employee who works part-time (week), you just need to set the usual number of working hours for an accounting period (for example, a working week). For this, we must also proceed from the working hours established for this category of workers (for example, 40 hours per week). With all this, for all modes of work and rest, the norm of working time is calculated according to the estimated schedule of a five-day working week with 2 days off on Saturday and Sunday based on the duration of daily work (shift). Undoubtedly, it is worth mentioning that, for example, with a 40-hour working week, the norm of daily working hours is eight hours.
As for female employees who work part-time (shift) and (or) part-time, as many think, working week, we must reduce their usual number of working hours for the accounting period (Article 104 of the Labor Code of the Russian Federation). Imagine one fact that, namely, with a 40-hour work week with 2 days off on Saturday and Sunday, the norm of working time, in the end, will be the number of hours that will be obtained by dividing, as everyone knows, established the duration of the working week for 5 days.
Working on the criteria of part-time work does not entail any restrictions for the employee of his labor rights - the duration of the main annual paid leave and the calculation of seniority do not change (part 3 of article 93 of the Labor Code of the Russian Federation).
Example
The senior specialist of the public relations department, Tatyana B., at her request, was assigned part-time work. According to the terms of the labor contract, she is obliged to work 30 hours per week. Thus, in this case, Tatyana's working time will be 6 hours a day (30: 5 = 6).
With all this, it is essential for the employer to keep in mind that an additional day of rest for the employee is, as it were, a day off. It is also possible that he can be involved in work on this day only with written consent (Article 113 of the Labor Code of the Russian Federation). And with an incomplete working day, work outside the established duration (even if it fits within the framework of "normal" eight working hours) is considered overtime work (Article 99 of the Labor Code of the Russian Federation). Few people know that because it is fundamentally important to keep in mind that you have no right to lure a pregnant employee into such work (part 1 of article 259 of the Labor Code of the Russian Federation).
How to pay for a part-time employee
If an employee works part-time, then this must be paid in the following way. Calculate wages in proportion to the hours worked or depending on the amount of work performed (part 2 of article 93 of the Labor Code of the Russian Federation). It must be said that the average earnings of an employee for benefits for temporary incapacity for work, for pregnancy and childbirth and for monthly childcare benefits are determined in a similar way.
Example
Ira M. works part-time and receives a salary depending on the amount of work performed (50 rubles for one piece). In March, an employee made 350 parts on the machine. Thus, her salary this month will finally reach 17,500 rubles. (350 x 50).
If the employee has worked more hours, this will be considered overtime work. Therefore, the first two hours must be paid in more than one and a half amount, and the next hours - in more than double the amount (Article 152 of the Labor Code of the Russian Federation).
You will be able to demand from the employee a document confirming the basis for part-time work (for example, a certificate from the antenatal clinic about pregnancy).
Example
Senior economist Galina S. with a part-time working week (36 hours per month) receives 30,000 rubles. per month. On March 12, she was lured into overtime work for three hours. Everyone knows that we will calculate the amount of the surcharge according to the following formula:
